Terms of Service

1. The Service

Brambling provides location-aware audio tours for public transport, walking, cycling, and driving routes. The Service uses your device’s location to trigger audio content at the appropriate points along a route. Content is provided for information and entertainment only.

2. Eligibility and accounts

You must be at least 16 years old to use the Service. To access certain features you may create an account using your email address; we sign you in using a one-time code sent to that address rather than a password. You are responsible for keeping access to your email account secure and for activity that takes place under your account.

3. Purchases, billing, and refunds

Brambling is free to download and includes sample content. Some tours and passes are available as paid purchases. All purchases are processed by the Apple App Store or Google Play, and are subject to their respective terms and payment policies. Refunds are handled by Apple or Google in accordance with those policies; please contact the relevant store for refund requests.

4. Acceptable use

You agree not to:

• Use the Service in any unlawful way or for any unlawful purpose.
• Copy, redistribute, resell, or publicly perform our audio content or other materials without permission.
• Attempt to reverse engineer, interfere with, or disrupt the Service or its security.
• Access the Service using automated means except as expressly permitted.

5. Safety

Brambling is an audio guide, not a navigation or safety system. You remain fully responsible for your own safety and awareness of your surroundings at all times. Do not use the Service in a way that distracts you from traffic, your route, or hazards around you. Always follow the rules of the road, transport operators’ instructions, and local laws. Never handle your device while driving.

6. Intellectual property

The Service, including its audio content, text, software, branding, and design, is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use, subject to these Terms.

7. Third-party services

The Service relies on third-party providers (for example, hosting, email delivery, mapping, and app-store billing) and may link to third-party content. We are not responsible for the availability, accuracy, or policies of third-party services. Your use of those services is governed by their own terms.

8. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that content is accurate or complete. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential loss arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.

9. Termination and account deletion

You may stop using the Service at any time and can delete your account from within the app, which removes your account and associated personal data as described in our Privacy Policy. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
